These general terms and conditions apply to all content and Internet services provided by Permapotes.com, regardless of how they are marketed. 2. Scope of application

Permapotes offers on its Site restricted access content and services on a subscription basis. These general terms and conditions of sale (GTCS) as set out in this document govern the use of the Site and the marketing of subscriptions allowing restricted access to content and services. These general terms and conditions are concluded for the entire duration of the subscription.

3. Access to the site
3.1 Conditions of access

The equipment enabling access to the Site is the exclusive responsibility of the Subscriber, as are the telecommunications costs incurred by its use. It is the Subscriber's responsibility to take all necessary measures to ensure that the technical characteristics of his or her equipment allow him or her to consult the Content.

The Subscriber is also responsible for the use of the Content.

The Subscriber acknowledges the Company's right to temporarily interrupt access to the Site when the Site or any linked server is being updated or maintained. In this hypothesis, the Company will endeavour to limit the inconvenience for Subscribers by reducing the period of interruption to the minimum time necessary to carry out the operation in question.

3.2 Identifiers

Only the Subscriber is authorised to access the Content for which it has taken out a Subscription by identifying itself using its login and password. The Subscriber undertakes to keep his Identifiers strictly confidential. The subscription is strictly personal, the Subscriber may not cé or preêulate à a third party his access identifiers unless authorized by the Publisher.

3.3 Access to content

The Permapotes.com website offers content that can be accessed free of charge as well as other content that is only available to Subscribers. This restricted access content and services are accessible for the duration of the subscription. Once the subscription is terminated, the subscriber loses access to the Restricted Content. It is therefore the responsibility of the subscriber to save (screen capture, paper or PDF printout, copy and paste onto a text editor, etc.) the content and results of the services that he/she wishes to consult once the subscription has expired.

3.4 Limitation of access

The Publisher will do its utmost to ensure that the Site is accessible to the Subscriber. However, in the event of force majeure, a fault on the part of the Customer or an unforeseen event (e.g. attempted hacking or the unavailability of the host), the Publisher may not be held responsible for the interruption of the service.

As the site offers community functions, the Publisher reserves the right to limit certain functions of the Subscriber if it considers that the Subscriber's behaviour is aggressive, inappropriate or illegal. In the event of piracy or attempted piracy by a User, the Publisher reserves the right to completely block their access.

4. Subscription
4.1 Price

Subscription prices are quoted in euros, inclusive of all taxes (VAT) regardless of the country from which the subscription is made. They do not include the costs associated with the equipment and electronic communications required to subscribe to and use the services, said costs remaining the responsibility of the subscriber. All orders, irrespective of their origin, are payable in euros.

The price of the Subscription may change over time. The price applied to an order therefore corresponds to the price announced at the time of the order.

4.2 Subscription

The Subscription is subscribed exclusively online by bank card (Visa, Mastercard). Payment is made using a secure solution that incorporates an SSL (Secure Socket Layer) encryption process or any other equivalent process. The Subscriber must be a person with the legal capacity to contract. He/she orders on the site with the aim of accessing restricted access content and services at the prices and conditions indicated. The Subscriber is solely responsible for payment by credit card. The Publisher accepts no responsibility for any payment difficulties encountered by the Subscriber and invites the Subscriber to contact his bank if necessary.

Confirmation of payment constitutes acceptance of the Subscription application by the Publisher subject to actual collection of the payment. The Subscriber acknowledges that the Site's automatic recording systems are proof of the nature, content and date of the Subscription request. The data recorded by the payment system constitutes proof of the financial transaction.

4.3 Delivery

Once the Subscription has been taken out, a confirmation e-mail will be sent to the Customer confirming access to the Restricted Content. It is the Customer's responsibility to check the Indirect Mail folder if they do not receive this e-mail in their inbox.

4.4 Renewal

The subscription is concluded for a period of one year (1 year) according to the price indicated on our page « Subscriptions » and is automatically renewed à theéchéance. If the Subscriber wishes to cancel the automatic renewal, he/she can do so by logging into the Manage my subscription area available in the Profile settings. If another means of payment has been used, an e-mail may also be sent to the subscription[at]permapotes.com address to request cancellation of the automatic renewal of the Subscription at least 30 days before the renewal date.

4.5 Right of withdrawal

When the Customer rés à an offer of contract à distance by électronic means, he/she has the right to notify à the Company that he/she renounces à the purchase, without penalty and without giving any reason, within fourteen (14) calendar days. The refund will be made by the same method of payment used by the Customer.

A Customer who withdraws from the purchase must give notice of this in writing, before the 14-day period expires, by sending an e-mail to the following address: abonnement[at]permapotes.com, and at the same time returning any products delivered in their original packaging and in good condition. The Customer shall bear the direct costs incurred by returning the products. The right of return is, however, excluded in the event that the use of the download has been initiated by the Customer.

5. Liability

While we make every effort to provide a reliable service, it remains first and foremost informative. The presence of bugs or inaccurate, imprecise or erroneous content cannot engage the responsibility of the Publisher. In no event shall the Publisher be liable for any damages whatsoever, including but not limited to loss of use, loss of data, loss of business opportunity or any other loss or damage whatsoever;In addition, no assistance will be provided to the user of the products and services referred to herein. In addition, any assistance provided by the Publisher in the use of the products and services shall not create any additional warranty with respect to these terms.

6. Applicable law

Belgian law alone governs our sales, subscriptions and licences. In the event of a dispute, only the courts of Tournai (Belgium) will be competent and settled according to the rules of procedure. The attribution of jurisdiction to the courts of Tournai is general and applies regardless of whether it is a question of a principal claim, an incidental claim, an action on the merits or a dispute, regardless of the place of delivery and the method of payment. The Customer accepts this attribution of jurisdiction without any restriction or reserve.
