Terms of Sales

These general conditions apply to all content and Internet services provided by Permapotes.com, regardless of the marketing method. It is recommended to read these general conditions carefully before any use or order on the site. If you have any questions, contact us before ordering.


1. Definitions
  • “Site” means the entire content of the Permapotes.com site
  • “Publisher” (“we” or “Permapotes”) refers to the company publishing the site Permapotes.com, registered in the Belgian business register under number 0848310629 and represented by Arnaud Deschamps.
  • “User” means any natural person using the Site
  • “Subscriber” (“customer” or “you”) means any natural or legal person who has subscribed to a Subscription.
  • “Subscription” means any subscription to a paid content offer on the site.
  • “Content” means all information and content accessible on the Site.
  • “Restricted Content” means all information only accessible to Subscribers on the Site. Restricted content may vary depending on the Subscription chosen.

2. Scope

Permapotes offers on its Site content and services in restricted access by subscription. These general conditions of sale (CGV) as summarized in this document govern the use of the site and the marketing of subscriptions allowing access to content and services with restricted access. These general conditions are concluded for the entire duration of the subscription.

Any subscription implies unreserved acceptance of these general conditions and must be in accordance with applicable law. These general conditions may be subject to modification, in which case the general conditions applicable to a subscription would be those in force on the site at the time of subscription.


3. Access to the site
3.1 Conditions of access

The equipment allowing access to the Site is the exclusive responsibility of the Subscriber, as are the telecommunications costs incurred by their use. It is up to the Subscriber to take all necessary measures to ensure that the technical characteristics of his equipment allow him to consult the Content.

The Subscriber acknowledges the Company's right to temporarily interrupt access to the Site, when it or any linked server is subject to an update or maintenance operation. In this case, the Company will endeavor to limit the inconvenience for Subscribers by reducing the interruption period to the minimum time necessary to carry out the operation in question.

3.2 Identifiers

Only the Subscriber is authorized to access the Content for which he has subscribed to a Subscription by identifying himself using the login and password. The Subscriber undertakes to keep his Identifiers strictly confidential. The subscription is strictly personal, the subscriber cannot transfer or lend his access credentials to a third party without authorization from the Publisher.

3.3 Access to content

The Permapotes.com site offers content accessible free of charge as well as other content only reserved for Subscribers. These restricted access contents and services are accessible throughout the duration of the subscription. Once the subscription is terminated, the subscriber loses access to Restricted Content. It is therefore up to the subscriber to save (screen capture, paper or PDF printing, copy and paste into a text editor, etc.) the contents and results of the services that they wish to consult once the subscription has expired.

3.4 Limitation of access

The publisher will do everything possible to ensure that the Site is accessible to the Subscriber. However, in the event of force majeure, fault of the Client or unforeseeable event (e.g. <:> hacking attempt or unavailability of the host), the publisher cannot be held responsible for the interruption of the service.

As the site offers community features, the Publisher reserves the right to limit certain features of the Subscriber if it considers that their behavior is aggressive, inappropriate or illegal. In the event of hacking or attempted hacking by a User, the Publisher reserves the right to completely block their access.


4. Subscription
4.1 Price

Subscription prices are indicated in euros, all taxes included (VAT) regardless of the country from which the subscription is made. They do not include costs related to equipment and electronic communications, necessary for the subscription and use of the services, said costs remaining the responsibility of the subscriber. All orders, whatever their origin, are payable in euros.

The price of the Subscription may change over time. The price applied to an order therefore corresponds to that announced at the time of the order.

4.2 Subscription

The Subscription is exclusively taken out online by credit card (Visa, Mastercard). Payment is ensured by a secure solution which integrates an encryption process in SSL (Secure Socket Layer) mode or any other equivalent process. The service is currently secured by the international and secure platform Stripe.com.

The Subscriber must be a person with the legal capacity to contract. He orders on the site in order to access content and services with restricted access at the prices and conditions indicated. The Subscriber is solely responsible for payment by credit card. The Publishing Company disclaims any responsibility for payment difficulties encountered by the Subscriber and invites the Subscriber to contact their bank if necessary.

Payment confirmation constitutes acceptance of the Subscription request by the Publisher subject to actual receipt of payment. The Subscriber acknowledges that the Site's automatic recording systems constitute proof of the nature, content and date of their Subscription request. The data recorded by the payment system constitutes proof of the financial transaction.

4.3 Delivery

Once the Subscription has been purchased, a confirmation email will be sent to the Customer confirming access to the Restricted Content. It is the Customer's responsibility to check the Junk Mail folder if they do not receive this email in their email inbox.

4.4 Renewal

The subscription is concluded for a period of one year (1 year) following the price indicated on our “Subscriptions” page and is automatically renewed upon expiry. If the Subscriber wishes to cancel automatic renewal, he or she can deactivate it by logging into the “Manage my subscription” area available in the Profile Settings. If another means of payment was used, an e-mail can also be sent to the address subscription[at]permapotes.com to request the cancellation of the automatic renewal of the Subscription at least 30 days before the date of renewal.

4.5 Right of withdrawal

When the Customer responds to a distance contract offer electronically, he has the right to notify the Company that he renounces the purchase, without penalties and without giving reason, within fourteen (14 ) calendar days. The refund will be made to the same payment method used by the Customer.

For the exercise of this right, the time limit runs <:>

  • For products, from the day after the day of delivery to the Customer
  • For services, from the day after the day on which he receives confirmation of his order by e-mail.

The Customer who renounces the purchase must notify it in writing, before the expiration of the 14-day period, by sending an e-mail to the address <:> subscription[at]permapotes.com, and simultaneously return any products delivered in their original packaging and in good condition. The Customer bears the direct costs generated by returning the products. The right of withdrawal is however excluded in the event that use of the download has already been started by the Customer.


5. Responsibility

Even though we do everything we can to provide a reliable service, it remains primarily informative. The Publisher cannot be held liable for the presence of bugs or inaccurate, imprecise or erroneous content. Under no circumstances can the Publisher be held responsible for any damage of any nature whatsoever, including operating loss, loss of data, loss of opportunity or any other financial loss resulting from the use or the inability to use the products and services referred to herein. In addition, no assistance provided by the Publisher in the use of the products and services can create any additional guarantee in relation to these conditions.


6. Applicable law

Belgian law alone governs our sales, subscriptions and licenses. In the event of a dispute, only the courts of Tournai (Belgium) will have jurisdiction and be determined according to the rules of procedure. The attribution of jurisdiction to the courts of Tournai is general and applies, whether it is a main request, an incidental request, an action on the merits or an interim order, whatever the place of delivery and method of payment. The Client accepts this attribution of jurisdiction without any restriction or reservation.
